Congress Moves to Ban Hemp Products Containing THC

A rushed government-funding deal could outlaw full-spectrum hemp wellness

If you value the benefits of hemp products that include trace amounts of THC, it’s time to pay attention. A funding bill rushed through Congress to reopen the government includes language that would effectively impose a nationwide hemp THC ban, outlawing all hemp-derived products containing THC—even naturally occurring low doses.

What this means for hemp and your wellness routine

Under current law, hemp and hemp-derived products may contain up to 0.3 % THC by dry weight.
The new provision in the funding deal would instead cap finished hemp products at just 0.4 milligrams total THC per container—not 0.4 mg per gummy, mint, or serving, but per entire bottle, packet, vape, or or beverage.

That change would wipe out virtually all full-spectrum CBD tinctures, hemp seltzers, and  gummies that currently meet the federal definition of hemp.

The language was meant to stop high strength and dangerous synthetic THC products from being sold outside regulated dispensaries—a goal widely supported in the hemp industry and by Rare Cannabinoid Company—but it was written so broadly that it also bans safe, naturally occurring, low-dose THC used in countless wellness formulas.

How to interpret this from a wellness standpoint

At Rare Cannabinoid Company, this would affect some of our products that contain small, naturally occurring amounts of THC—such as our full-spectrum Hawaiian CBD, Mood Gummies, Rapid Relief Gel, and other oils, edibles or topicals that include any amount of hemp-derived THC.

However, it’s important to note that not all products are affected. Hemp items that contain zero THC remain fully legal.

THC is one of more than a hundred cannabinoids found in hemp. In low, natural amounts, it contributes to relaxation, relief, and overall balance, enhancing the effects of other cannabinoids like CBD, CBC, and CBG.

What remains legal and available

Even without THC, hemp offers a remarkable range of naturally occurring cannabinoids that continue to provide distinct benefits on their own—or, where permitted, can be paired with THC from a local dispensary for a balanced experience:

  • CBN for deep relaxation and sleep

  • CBG for sore or swollen joints or muscles

  • THCV for energy, focus, and appetite control

  • CBDV for social ease, memory, and irritability

  • CBC for mood improvement and motivation

  • CBD for stress relief, balance, and calm

What happens next

Industry leaders, farmers, and wellness advocates have voiced strong opposition to this over-broad THC ban, warning it will harm small hemp businesses and limit consumer access to safe, plant-based wellness products. The measure, however, is currently included in the package to reopen the government and is expected to be signed into law soon.
