What the New THC Rule Means for Your Hemp Products

The new federal THC limit has been signed into law, but hemp wellness products are expected to remain legal for a year while the industry fights for fair regulations.

If you value the benefits of hemp products that include trace amounts of THC, it’s time to pay attention — though you don’t need to panic just yet. A funding bill to reopen the government, recently signed into law by President Trump, includes language that would effectively impose a nationwide hemp-THC ban. It outlaws all hemp-derived products containing THC — even naturally occurring, low doses found in full-spectrum hemp products.

The good news: the current wording of the provision says it will not take effect for one full year, giving the hemp industry and advocates time to mobilize, push for revisions, and fight for fair, science-based regulations that protect consumers while preserving access to natural hemp products.


What this means for hemp and your wellness routine

Under current law, hemp and hemp-derived products may contain up to 0.3% THC by dry weight and still qualify as “hemp.”

The new provision replaces that definition and instead caps finished hemp products at just 0.4 milligrams total THC per container — not 0.4 mg per gummy, mint, or serving, but per entire bottle, packet, vape, or beverage.

This drastic change would wipe out virtually all full-spectrum CBD tinctures, hemp seltzers, and gummies that currently meet the federal definition of hemp.

The language was originally intended to stop dangerous high-strength and synthetic THC products from being sold outside regulated dispensaries — a goal that Rare Cannabinoid Company and many others in the hemp industry support. However, it was written so broadly that it also bans safe, naturally occurring, low-dose THC used in countless wellness formulas.


How to interpret this from a wellness standpoint

At Rare Cannabinoid Company, this would affect some of our products that contain small, naturally occurring amounts of THC — such as our full-spectrum Hawaiian CBD, Mood Gummies, Rapid Relief Gel, and other oils, edibles, or topicals that include any amount of hemp-derived THC.

However, it’s important to note that not all products are affected. Hemp items that contain zero THC would remain fully legal.

THC is just one of more than a hundred cannabinoids found in hemp. In low, natural amounts, it contributes to relaxation, relief, and overall balance, enhancing the effects of other cannabinoids like CBD, CBC, and CBG.


What would remain legal and available

Even without THC, hemp offers a remarkable range of naturally occurring cannabinoids that continue to provide distinct benefits on their own — or, in states where allowed, can be paired with THC from local dispensaries for a balanced experience:

  • CBN for deep relaxation and sleep

  • CBG for sore or swollen joints or muscles

  • THCV for energy, focus, and appetite control

  • CBDV for social ease, memory, and irritability

  • CBC for mood improvement and motivation

  • CBD for stress relief, balance, and calm

What happens next — and what this means for you

Industry leaders, farmers, and wellness advocates have voiced strong opposition to this over-broad THC ban, warning that it could threaten more than 300,000 jobs and harm small hemp businesses across the country. Many have stressed that this decision reverses years of progress since hemp was federally legalized in 2018 and could push safe, reputable companies out of the market.

While the new law is now official, the ban is not supposed to take effect until late 2026, giving the hemp community one year to fight back. Lawmakers, business leaders, and advocacy groups are already preparing a coordinated effort to replace the ban with reasonable federal standards for testing, labeling, and age restrictions — not prohibition.

Rare Cannabinoid Company supports sensible safety regulations that protect consumers from untested or synthetic products. However, we strongly oppose a blanket ban on all THC, which would erase the natural balance that makes full-spectrum hemp products so effective and enjoyable.
